These Terms of Service (“Terms”) govern your use of the sites, services, and forums operated under the umbrella of filesdontlie.com (the “Site”). By accessing or using any part of the Site—including the music‑file repository, the public forum, and any political‑Super‑PAC‑related pages—you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. File‑Hosting – Upload, store, stream, and download user‑submitted files.
2. Public Forum – Open discussion board for comments, reviews, and community interaction.
3. Merchandise Store – Branded apparel, accessories, and physical media sold under the filesdontlie.com brand.

These services are provided separately but governed by a single set of Terms for simplicity.

2. Acceptance of Terms

By creating an account, uploading content, posting a comment, or otherwise interacting with the Site you affirm that:

You are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher).

You have read, understood, and accept these Terms, our Privacy Policy, and any additional policies referenced herein.

3. Account Registration & Security

Eligibility: Only individuals who can form legally binding contracts may register.

Credentials: You must provide a valid email address and create a password. You are responsible for safeguarding your login credentials.

Account Integrity: Do not share your account, impersonate others, or create multiple accounts to evade bans or contribution limits.

4. User‑Generated Content (UGC)

4.1 Ownership & Licensing

You retain ownership of any content you upload or post (audio files, text, images, etc.).

By submitting UGC you grant us a worldwide, royalty‑free, non‑exclusive, sublicensable license to host, display, distribute, and archive the content solely for the purpose of operating the Site.

4.2 Representations & Warranties

You represent and warrant that all UGC you provide:

Is your original work or you have obtained all necessary rights, licenses, and permissions from the rightful owners.

Does not infringe any copyright, trademark, trade secret, or other proprietary right.

Is not defamatory, false, or misleading toward any person or entity.

Contains no illegal material (e.g., child sexual abuse material, illicit drug instructions, or extremist propaganda).

Complies with all applicable laws, including campaign‑finance regulations when posted in the Super‑PAC section.

4.3 Prohibited Content

You may not upload or post:

Copyrighted material without permission.

Defamatory, harassing, hateful, or threatening language.

Spam, unsolicited commercial messages, or pyramid‑scheme content.

Any content that violates the Federal Election Commission (FEC) rules or other election‑law statutes.

Violations may result in immediate removal of the offending material and/or termination of your account.

5. Copyright & DMCA

5.1 Designated Agent

We have registered a DMCA Designated Agent. Notices of alleged copyright infringement should be sent to:

5.2 Takedown Procedure

Upon receipt of a valid DMCA notice we will:

Promptly remove or disable access to the allegedly infringing material.

Notify the uploader of the removal.

Provide the uploader an opportunity to submit a counter‑notice.

Repeated infringers will have their accounts terminated in accordance with our Repeat‑Infringer Policy.

6. Defamation & Liability

Section 230 (U.S.): To the extent permitted by law, we are not liable for user‑generated statements. However, we reserve the right to remove content that is demonstrably false and harmful.

International Jurisdictions: Where Section 230 does not apply, we will act in good faith to address defamation claims promptly.

7. Privacy

Our Privacy Policy (incorporated by reference) explains how we collect, store, and process personal data, including compliance with:

GDPR (European Union) – Right to access, rectify, erase, and port data.

Upon termination, all licenses granted under Section 4.1 cease, and we may delete your content at our discretion.

10. Governing Law & Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of California, United States, without regard to conflict‑of‑laws principles.

Venue: Any action arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California.

Arbitration (optional): For any dispute not resolved informally, the parties may elect to resolve the matter by binding arbitration under the AAA Commercial Arbitration Rules, unless prohibited by law.

11. Changes to the Terms

We may revise these Terms from time to time. When we do, we will post the updated version on the Site and update the “Effective Date” at the top. Continued use of the Site after such changes constitutes acceptance of the revised Terms.
